Trademark Registration Service Plan

一、簡介 Introduction：

商標(也稱書面商標或商標)是一種知識產權，由可識別的標志、設計或表達組成，用以識別特定來源的產品或服務與其他來源的產品或服務。

A trademark (also written trademark or trademark) is a type of intellectual property consisting of a recognizable sign, design, or expression which identifies products or services of a particular source from those of others.

二、商標注冊的要求 Requirements：

1:商標所有人的姓名和地址 Provide your name and address as owner of the trademark；

2:說明實體類型(個人或公司)和申請人的的國籍 

State the entity type (individual or corporation) and your national citizenship；

3:展示商標在商業上的實際使用或真正意圖 

Demonstrate actual use or a real intent to use the trademark in commerce；

4:詳細描述該商標 Give a detailed description of the product being trademarked；

5:交商標圖樣或樣本 Submit a drawing or specimen of the trademark；

6:供商標首次使用的日期 Offer the date of the first use of the trademark；

7:授權委托書 Power of attorney；

三、注冊流程 Registration Procedure：

第一步:商標搜索

對知識產權網站上各種類似標記的組合進行搜索。如果發現類似的標記，請檢查說明，以確

定該標記是否代表您?出的同一套商品或服務。

The first step is trademark search. The search should be done in both for various combination of similar marks on the intellectual property website. In case similar marks are found, check the description to see if the mark represents the same set of goods or services proposed by you.

第二步:申請準備

商標代理人準備一份申請書。商標申請人須準備表格 48 及 TM-1 以供審批及簽署

In the second step, an application is prepared by the Trade Mark Attorney. Form 48 and TM-1 will be

prepare for approval and signature of the trademark applicant.

第三步：商標注冊。個人、創業、小型企業注冊商標。向當地政府機關繳納一定的費用。

第四步:政府處理 一旦交了商標申請，并且政府正在處理該申請，則必須定期檢查商標申請的狀態。如有異 議，申請人必須在 30 天內?交異議回復。同樣，如有反對意見，申請人必須在限期內作出 回應，以免官方?出異議

Once a trademark application is filed and the Government is processing the application, the status of the trademark application must be checked periodically.

In case of objection, an objection reply must be submitted by the applicant within 30 days.

Similarly, in case of opposition, the applicant must respond in a time-bound manner to allay the

concerns of the counter-party.

備注：商標注冊期間，如商標辦公室?出異議，需要及時回復異議，并?交相應要求的補充

文件。也會根據申請商標的實際情況，當局要求進行當面申訴。

Note: during the period of trademark registration, if the trademark office raises an objection, it shall reply to the objection 3 in time and submit the supplementary documents as required. The authorities will also request a face - to - face appeal based on the actual circumstances of the trademark application.

四、周期 Timeframe： 

商標注冊是一個漫長的過程，在沒有任何異議或反對的情況下，在一個直接的案例中獲得注

冊需要大約 18-24 個月。如當局出任何異議時間順延。

Trademark Registration is a lengthy process and it takes around 18-24 months to obtain registration in a straight-forward case, without any objections or oppositions. However, the trademark application number is usually issued within one or 2 days after filing. Delay in case of any objection.
