一、香港商標注冊說明 About trademark registration in Vietnam

1、香港特別行政區，實行一國兩制，擁有高度的自治，有自己的立法機關，香港商標的注冊基于使用在先原則為主。

The Hong Kong Special Administrative Region, with one country, two systems, a high degree of autonomy, has its own legislature, and its trademark registration is based on the principle of priority in use.

2、香港接受商品商標、服務商標、系列商標、證明商標、防御商標、形狀商標、氣味商標的申請注冊。

Hong Kong accepts applications for registration of trade marks, service marks, series marks, certification marks, defensive marks, shape marks and odor marks.

3、商標保護具有地域性，在中國大陸注冊的商標在香港并不受保護，必須在香港注冊才能在香港受保護。Trademark protection is regional. Trademarks registered in mainland China are not protected in Hong Kong and must be registered in Hong Kong to be protected in Hong Kong.

4、申請人在提交香港商標注冊申請之前6個月內，已就相同商品或服務在巴黎公約國或世貿?成員國提交該商標的注冊申請，可享有商標注冊優先權。Within 6 months prior to the filing of the application for the registration of a Hong Kong trademark, the applicant has filed an application for the registration of the same trademark in a Paris Convention country or a WTO member country with respect to the same goods or services, and may enjoy the priority of trademark registration.

 二，商標注冊申請條件    Trademark registration Application conditions

1、可以以自然人或法人申請；?

May apply as a natural or legal person.

2、提供商標的中文或外文名稱；?

Provide the Chinese or foreign name of the trademark.

3、須保護的商品名稱或專案清單；?

Trade name or list of items to be protected.

4、如果您的商標為彩色，必須指定哪種顏色。?

If your logo is color, you must specify which color.

三、注冊資料提交前須評估事項?Items to be evaluated before submission

1、 商標是否足以識別商標擁有人與其他商戶的貨品或服

Is the trademark sufficient to identify the goods or services of the trademark owner and other merchants.

2、 商標能否特顯其貨品及服務?

Can a trademark show its goods and services.

3、 商標是否為行業通用語言/用詞?

Whether the trademark is a common language / word in the industry.

4、 商標是否與其它商標相同或相似

Whether the trademark is the same or similar to other trademarks.?

四、商標注冊所需材料Materials required for trademark registration

1、 注冊商標申請表格及授權委托書

Name and address of applicant in Chinese and English?
